Consumer rights changes to buyer protection and refunds after Brexit

The UK left the European Union (EU) at the end of January 2020 and entered an implementation period which ended on 31 December 2020. Most of the EU directives around consumer rights have now been incorporated into UK law. However, some consumer rights affecting your protection as a buyer from an EU seller could change. Find out what you need to know about any changes that might affect your consumer rights and protections.

Will refund protection under section 75 of the Consumer Credit Act still apply to goods and services bought with my UK credit card after Brexit?

Yes, section 75 is UK legislation – so is unaffected by the UK leaving the EU.

It means you can claim refunds from your credit card provider if a retailer or trader is in breach of contract or mispresents goods or services.

Section 75 also applies to foreign transactions as well as goods bought online, by phone or mail order for delivery to the UK from overseas.

What protection will I have when buying goods and services abroad?

From 1 January 2021, always check the terms of consumer protection offered by the seller and the seller’s EU country to see if the level of protection is different from the UK’s.

And check what governing law applies, as you won't be protected in the same way as if you bought from a UK retailer. 

It’s unlikely that you’ll be able to enforce your legal rights in the EU via UK courts.
